The combination of tourist services proposed to you is a package within the meaning of Directive (EU) 2015/2302. Therefore, you will benefit from all EU rights that apply to packages. The travel organizer (as defined by art. 32, co. 1, lett. i of the Tourism Code) is Sport and Fun Holidays s.r.l. based in Casalecchio di Reno (Bo), via del Lavoro n. 71, tel. 051.3547570, email address info@nbabasketballschool.it, pec address safh@legalmail.it who will be fully responsible for the proper execution of the package as a whole. In addition, as required by law, Sport and Fun Holidays s.r.l. has protection to refund your payments and, if transportation is included in the package, guarantee your repatriation should you become/become insolvent. This insolvency guarantee is provided by Vacanze Felici S.c.a.r.l., with registration number 1422. Annex Basic rights under Directive (EU) 2015/2302.

Sport and Fun Holidays s.r.l. – in its capacity as a tour operator i.e. an organizer who professionally combines and offers for sale tourist packages and services – organizes and provides – also on behalf of Third Parties (such as, Amateur Sports Associations, Professional Sports Companies, Commercial Companies) – tourist services for children and young people aged between 6 and 20 years, in seaside and/or mountain tourist locations, within accommodation facilities suitable for hosting minors unaccompanied by their parents (hereinafter also referred to as “Camp”), daily and multi-day sports events in Italy and abroad, hereinafter also referred to as “Summer Experience,” “Player Clinic,” and “Camp,” together hereinafter also referred to as “Events.”

A) THE MAIN FEATURES ON TOURISM AND SPORTS SERVICES OFFERED:

Modalities:

• “Player Clinics” are sports events lasting about 90 minutes
  “Summer Experiences” are daily or multi-day sports events in daytime form without an overnight stay
  “Camps” are sports experiences of varying duration, with or without overnight stay, in Italy and abroad

All events take place at the locations, times and in the manner indicated in the programs published on the specific dedicated pages on the website www.nbabasketballschool.it.

Participants: the participants, depending on the event, can be divided into groups according to age, skills assessed by the Technical Management and other parameters useful and functional for the success of the event

Locations: events take place in Italian and foreign locations and are always described on the dedicated page of the website.

Time and duration: the Player Clinics take place mostly in spring and autumn, the Summer Experiences take place between June 1 and September 15, and the Camps take place throughout the year, particularly the “Summer Camps” between June 1 and September 15.

Event start: participants must report at the place and time predetermined in the program and communicated through communication from the organizing secretary in the days prior to the start of the event. Normally, the Camp runs from Sunday afternoon and ends the following Saturday, with departure before lunch. The Day Camp formula starts on the morning of the second day of Camp (Monday) and ends on the morning of the last day (Saturday).

Registration: Registration requires: a) completion of the online registration form, b) payment of the participation fee c) competitive or non-competitive medical certificate d) delivery of the “Registration Form” signed by the parent or guardian.

Transportation: transportation service, when present, is never included in the package and can be purchased separately during online registration or later (no later than 15 days before the departure date and while availability lasts) by sending an email to info@nbabasketballschool.it. The transportation service is confirmed by the organizer within 14 days of the departure date.

Receptive facilities: when there are receptive facilities in which participants can stay, these can be equipped to carry out the recreational-sports-recreational activities within them or, in any case, are adjacent to the complexes where all the activities take place. Specifically:

by the sea: in Lido degli Scacchi they stay at the 3-star category Villaggio Florenz, inside bungalows with a maximum of 4 beds equipped with air conditioning and private bathrooms inside. The village is located directly on the sea with a private beach and inside there is a swimming pool, a restaurant, several shops, has two outdoor basketball courts and several areas suitable for recreational-sports activities.

in the mountains: in Piancavallo they stay at the Stella Montis hotel, a 3-star category, within multiple rooms all with private bathrooms. The hotel has ample indoor and outdoor safe spaces in which to spend unforgettable moments of recreation before and after training. The sports facility is less than 100 meters from the hotel: a gymnasium that houses three basketball courts side by side of excellent quality. In Tagliacozzo they stay at the Hotel Park hotel, a 3-star category, within multiple rooms all with private bathrooms. The hotel has sports spaces that we can use and a swimming pool. Sports activities could also be held at municipal facilities within walking distance of the hotel.

Meals provided: packages offered for Camp participants include full board for the overnight formula and only lunch Monday through Friday for the day formula. At the Player Clinics and Summer Experience, meals are not provided and therefore are not included in the participation fee.

Communication with the participant: If at the Camps the participant has a cell phone in tow, the same is taken into custody by the organization and handed over once a day, usually in the after-lunch time slot or before or after dinner, in order to be able to communicate with their family. If the participant does not have a cell phone in tow, the organization provides some phones so that they can call their parents. The Camp Manager is available 24 hours a day and can be contacted by the family for any needs. During the Player Clinic and Summer Experience, the cell phone is not taken into custody.

Services included in the total price: the services described in “The Fee Includes” section listed on the individual description pages of the Player Clinic, Summer Experience and Camp are included. The fee does NOT include extras of a personal nature, any pharmaceutical expenses and, in general, anything not listed as included in “The fee includes.”

Staff: The Organizer ensures the presence of a number of staff leaders appropriate to the number of participants.

Conduct: any serious violation of Camp rules, as well as, but not limited to, damaging sports and receptive facilities, disrespect to instructors, people working in receptive facilities and other participants, disrespectful behavior both during the conduct of activities and during free time, will result in the immediate expulsion of the person concerned, who will have to repay any damages caused.

Program and Changes: Each Player Clinic, Summer Experience and Camp has a specific program defined by the Organizational Management that includes educational, training and sports activities. The Organizational Management reserves the right to make changes to the program if special circumstances require it.

Language: services are provided in Italian and English.

C) PRICE:

the price of each individual Event is expressly stated on the reference page of the individual Player Clinic, Summer Experience, and Camp; this price is inclusive of all services listed and any fees. The price listed on the reference page of the individual Event chosen does not include the following possibly additional services based on the Event chosen: 1) transportation to/from the location, 2) photographic services, 3) guaranteed refund protection. Some of these additional services can be purchased at the time of online registration. All costs can be found within the individual Event pages.

D) MEANS OF PAYMENT:

1.Camp: except for promotions that might be active, the payment methods are as follows:

a) FULL CAMP FORMULA (with overnight stay):after the online registration, it is necessary to make the payment which can be made by Credit Card, PayPal or bank transfer. If made by bank transfer, the deposit fee to be paid is €250 for each week booked in addition to the practice management fee of €45 and the value of any personalized merchandise and clothing purchased during registration. The balance must be paid within 20 calendar days before the start of the camp.

b) DAY CAMP FORMULA (day camp formula): after registering online, payment must be made, which can be done by Credit Card, PayPal or bank transfer. If it is made by bank transfer, the deposit fee to be paid is €150for each week booked in addition to the practice management fee of €45 and the value of any personalized merchandise and clothing purchased during registration. The balance must be paid within 20 calendar days before the start of the camp.

2.Player Clinic and Summer Experience: after online registration, payment must be made, which can be made by Credit Card, PayPal or bank transfer.

E) GUARANTEED REFUND PROTECTION:

“Guaranteed Refund Protection” means a form of protection that Sport and Fun Holidays Srl makes available to the consumer for the purpose of protection in the event of cancellation of participation in the travel package before/during the same. Please refer to the specific page at www.championscamp.it for more details and all case histories. This protection can only be opted in during registration.

F) EVENTUAL PARTICIPATION ON CHARGE OF AN ASSOCIATION OR A THIRD PARTY:

In case of participation in a Camp organized on behalf of an Amateur Sports Association, a part of the price – as expressly indicated in the email summarizing the conditions of sale of the purchased package – must be paid directly to the aforementioned Association (fee for sports, educational, recreational and leisure activities) and a part of this amount is charged as a membership fee for those who are not already members. The additional part of the price (fee for tourist services), equal to the difference between the sale price of the Camp and the fee for sports, educational, recreational and leisure activities, must be made in favor of Sport and Fun Holidays s.r.l.

G) REFUNDS.

1) In case of waiver of participation in a Camp in Italy:

For those who have NOT purchased “Guaranteed Refund Protection”:

1.Refunds in case of cancellation within 30 days from the date of departure: you are entitled to a refund of 100% of the amounts paid net of:

a) Euro 250 per week in case of Full Camp and/or Euro 150 per week in case of Day Camp

b) practice management fee of Euro 45

c) fee for any personalized merchandising products and/or clothing (for cancellations after March 31)

2. Refunds in case of cancellation within 7 days from the date of departure: you are entitled to a refund of 50% of the amounts paid net of:

a) Euro 250 per week in case of Full Camp and/or Euro 150 per week in case of Day Camp

b) practice management fee of Euro 45

c) fee for any personalized merchandising products and/or clothing

d) any optional services that may be purchased (e.g., transfer service, video analysis, individual lessons, clothing, etc.)

3. No refund is granted to those who:

a) cancels in the 6 days before departure

b) does not show up at the departure

c) withdraws during the course

d) is not physically fit in case of sports camp

e) is expelled

f) falls ill or has an injury before and during the camp

g) withdraws due to lack of transfer service

Refunds in the event of unavoidable and extraordinary circumstances occurring at the place of destination or in the immediate vicinity that substantially affect the performance of the package or transportation to the destination: the participant has the right to withdraw from the contract, prior to the start of the Camp, without paying withdrawal fees and to a full refund of the payments made for the package but is not entitled to additional compensation.

2) In case of waiver of participation in a Summer Experience:

1. Refunds in case of renunciation due to health reasons: in case of renunciation due to health problems, objectively documented with an emergency room certificate (therefore, any certificate from a specialist or general practitioner will not be sufficient) the participant is entitled, at any time prior to the start of the activity, to a refund of the amount paid.

2. Refunds in case of cancellation within 30 days of the start date: one is entitled to a refund of the amount paid.

3. Refunds in case of cancellation within 7 days of the start date: you are entitled to a refund of 50% of the amount paid.

4. No refund is granted to those who:

a) cancel within 7 days before the start date

b) does not show up

c) withdraws during the course

d) does not possess physical fitness

e) is expelled

Refunds in the event of unavoidable and extraordinary circumstances occurring at the place of destination or in the immediate vicinity that materially affect the performance of the package or transportation to the destination: the participant has the right to withdraw from the contract, prior to the start of the Camp, without paying withdrawal fees and to a full refund of the payments made for the package but is not entitled to additional compensation.

3) In case of cancellation of participation in a Player Clinic:

1.Refunds in case of cancellation due to health reasons: in case of cancellation due to health problems, objectively documented with an emergency room certificate (therefore, any certificate from a specialist or general practitioner will not be sufficient) the participant is entitled, at any time prior to the start of the activity, to a refund of the amount paid.

2. Refunds in case of cancellation within 7 days from the date of the event: one is entitled to a refund of the amounts paid net of Euro 20, which includes the practice management and the eventual membership fee, which, in any case, are retained by the organization.

3. No refund is granted to those who:

a)cancels in the 7 days before the start
b) does not show up
c) withdraws during the course
d) does not possess physical fitness
e) is expelled

Refunds in the event of unavoidable and extraordinary circumstances occurring at the place of destination or in the immediate vicinity that materially affect the performance of the package or transportation to the destination: the participant has the right to withdraw from the contract, prior to the commencement of the Camp, without paying withdrawal fees and to a full refund of payments made for the package but is not entitled to additional compensation.

F) MINIMUM NUMBER OF PARTICIPANTS AND CANCELLATION:

The organizer of the Camp reserves the right to withdraw and terminate the contract, before the beginning of the package, in case of failure to reach the minimum number of participants in each individual Camp. This right may be exercised no later than twenty days before the start of the package in the case of trips lasting more than six days, seven days before the start of the package in the case of trips lasting between two and six days, forty-eight hours before the start of the package in the case of trips lasting less than two days. The organization reserves the right to cancel the Camp at any time for reasons that prevent it from taking place at any time with exclusive obligation to promptly notify the interested parties and return the amounts paid.

H) INSURANCE:

Sport and Fun Holidays s.r.l. is eventually liable only and exclusively under the terms provided by the insurance policies taken out. Sport and Fun Holidays s.r.l. is covered by a third party liability insurance contract by which it obligates itself to hold the participant harmless for whatever the participant is required to pay, as civilly liable as provided by law, as compensation (principal and interest expenses) for damages involuntarily caused to third parties, for death, personal injury and damage to property, as a result of an accidental event that occurred. Participants and educators are third parties to each other. The policy in place – underwritten by Sport and Fun Holidays s.r.l. – was contracted with ITAS Assicurazioni with limits of 2,500,000 euros and a fixed deductible of 150 euros. The policy to be referred to during the riding activity is that of the riding school and/or association at which the specific activity is carried out. Similarly, during activities at swimming centers such as swimming pools, the insurance policies to be referred to are those of the facility where such activities take place. Included in the fee is, for the benefit of each participant residing in Italy, the accident policy (maximum amount Euro 1,000.00 without deductible) that covers the participant’s injuries during the activities. Injury is defined as any external traumatic event occurring during activities outside or inside the accommodation facility. In addition, there is coverage for death (150,000 euros) and permanent disability (150,000 euros with a fixed deductible of 5 percent). With regard to the policy against accidents occurring during camp activities, claims determined by prior illnesses with symptoms in progress at the time of signing the policy and/or not declared in advance with appropriate medical documentation are not covered. The policy is contracted by Sport and Fun Holidays s.r.l. always with ITAS Assicurazioni. It is the participant’s right to take out any additional policies.

I) INSURANCE FOR RESIDENTS ABROAD:

It is mandatory for participants residing abroad (even if they have an Italian tax code) to take out health insurance for the duration of the Camp. If the participant already has a health insurance policy, we ask you to fill out the following document (Italian Version: Insurance declaration_ITA – English Version: Insurance declaration_ENG and email it to info@nbabasketballschool.it within 7 days of the start of the Camp. In case the participant residing abroad does not have a health insurance policy, it is possible to sign it after registering and in any case within 7 days from the beginning of the Camp.
